(hereinafter collectively referred to as "ATS"), collect, process and use your personal data as well as the manner in which we safeguard them.

ATS undertakes to comply strictly with the legal provisions on the protection of personal data as set out, inter alia, in Regulation (EU) 2016/679 of 27 April 2016 (General Data Protection Regulation, hereinafter "AVG").

ATS is committed to informing its customers and the parties involved in its activities about what personal data it holds, how it does so and the reasons why it does so. This information can be found in the current privacy policy.

The present privacy policy covers data where ATS acts as data controller, i.e. when ATS collects personal data for its own purposes and not on behalf of a customer or partner.

1. Responsible party.

Your data may be stored and processed by ATS in function of the execution of its activities and services. The data controller is ATS.

2. Categories of data.

The following categories of personal data may be processed by ATS :

▪ Surname and first name
▪ Language
▪ Place of residence
▪ Account number
▪ Fixed and/or mobile telephone
▪ E-mail address
▪ Nationality
▪ Camera images
▪ Activities on our website (cookies)
▪ IP address
▪ Any additional personal data provided

ATS does not process data revealing your racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, health or life data or sexual orientation, genetic data or biometric data.

3. Purpose and basis of the processing.

ATS will generally only process your personal data in the cases permitted by Article 6.1 of the GTC, i.e.:

▪ When necessary in function of executing a contract;
▪ In order to comply with a legal or regulatory obligation;
▪ When necessary to protect the vital interests of the data subject;
▪ When necessary to protect the legitimate interests of the company (e.g. prevention of fraud, internal administration, direct marketing,...);
▪ If you have given your consent.

ATS processes your personal data in particular for the following purposes:

▪ To enable ATS to perform the services it undertakes to provide optimally;
▪ To ensure the safety of its customers and staff;
▪ For the purposes of maintaining and improving the website;
▪ For statistical analysis of customers;
▪ To contact you - if necessary - in connection with services provided by ATS, this will mainly be the case if you are a customer of ATS;
▪ To send newsletters and offers to customers and other parties concerned;
▪ To protect the rights of ATS in the event of any dispute i.related to an act or activity of ATS.

These actions are either based on an agreement between the customer or data subject and ATS or on the justified interests of ATS to ensure proper and optimal service.

With regard to the legitimate interests of ATS, the data of the customers and persons concerned are used in order to provide them with communications about products or services similar or related to those which they have previously purchased or which they may use or have already used.

The processing of the personal data by ATS may also be justified by the legal obligations incumbent on ATS. In this context, ATS is subject, inter alia, to tax and accounting rules that require the retention and transfer of certain personal data to the competent administrations.

With regard to newsletters, ATS applies an opt-in policy. This means that ATS will only send newsletters to those involved or customers who have agreed to this.

4. Storage periods.

ATS will not retain your personal data any longer than is strictly necessary for the purposes for which the data was collected. ATS will therefore retain your data for a maximum of 1 year after the customer has made use of its products, services and facilities.

After this period, all personal data will be deleted except for the following categories

▪ Payment and invoice data will be kept for an additional period of 6 years (or a total of 7 years) in order to comply with tax obligations;
▪ If the customer wishes to receive the ATS newsletter;
▪ Any data which need to be kept due to legal obligations.

5. Transmission and third parties.

In principle, your data will only be processed internally by ATS (and any affiliated companies as well as their legal successors). In function of the execution of its objectives and tasks, data will also be shared and compiled with the following affiliated companies:

The personal data processed by ATS will be used by the various ATS employees in order to ensure the best possible service.

ATS hereby guarantees that its employees will only use and process those personal data that are necessary for the performance of his or her duties. ATS guarantees that any processing carried out by or for it by a processor will be carried out in accordance with the applicable regulations.

ATS also uses certain processors in order to keep its services optimal. These are:

▪ Internet environment (hosting website and WIFI facility);
▪ IT infrastructure (Servers, CRM, mail service etc.);
▪ ISP and telephony providers;
▪ Payment systems;
▪ Security companies

As these external parties may come into contact with personal data, ATS undertakes to conclude the necessary processing agreements with such external parties to ensure adequate protection of personal data.

Sometimes ATS is also obliged to transfer your personal data to third parties. This is mainly the case if a law or a court decision obliges us to do so or if public authorities have the right to request these data from us. In principle, your data will not be transferred to third countries (outside the European Union) nor to any international organisations except in the cases mentioned above.

Apart from these recipients, ATS will not pass on any personal data to any third party without your prior consent.

6. Rights of the data subject.

You have the right to access and correct any personal data that ATS holds about you. In addition, you can also request the deletion of your data in the cases provided for by the law, including:

▪ If the data are no longer needed for the purposes of processing.
▪ If you have withdrawn your consent and there is no other legal ground for processing
▪ If you have exercised your right to object
▪ In case of unlawful processing
▪ To comply with a legal obligation

You also have the right to withdraw the consent given for the processing of your personal data (if the processing is based on consent), and subject to its possible effect on any services

If you dispute the processing of the data by ATS, you may request the restriction of the processing until a solution to this dispute is found.

Finally, you also have a right to the transfer of your data if they are processed by automated means. You can also, without any justification, oppose the use of personal data for direct marketing.

In order to be able to verify the identity of the applicant and to prevent an unauthorised person from gaining access to personal data that does not concern that person, a copy of the front of your identity card or passport should be attached.

7. Cookies

When you visit the ATS website, ATS tries to make your experience as pleasant as possible. For that reason, we use cookies. ATS continuously monitors the security of the personal data stored and processed within its organisation. As a data controller and potential processor, ATS undertakes to take all necessary technical and organisational measures to prevent unauthorised persons from gaining access to the personal data entrusted to it. In doing so, it also endeavours to prevent the loss, destruction or unauthorised distribution of such data.

ATS uses systems that are regularly updated, restrict access to personal data and contain firewalls that comply with the applicable standard. ATS is committed to informing you of any breach of this privacy statement that could have a serious impact on you.

9. Adjustments.

ATS is free to unilaterally amend this privacy statement from time to time, if necessary in line with changing legislation. In such case, an announcement will be made on the website.
